High Court 13156 of 2026

REPUBLIC OF KENYA IN THE HIGH COURT OF KENYA AT MERU ADOPTION CAUSE NO. E004 OF 2026 DK RONO, J 28 JULY 2026 IN THE MATTER OF THE CHILDREN ACT, 2022 AND IN THE MATTER OF BABY H.H AND IN THE MATTER OF AN APPLICATION FOR ADOPTION BY S.T.K……………………………………………………………………….1ST APPLICANT M.N.W………………………………………………………….…………..2ND APPLICANT JUDGMENT 1. The applicants, S.T.K. and M.N.W, are husband and wife. They were married in 2005 under customary law; their marriage was subsequently registered under the Marriage Act and issued with a certificate, serial no. 45668* on 24th June 2021. The 1st applicant is a customer relations officer while the 2nd applicant is a technician. 2. The applicants have not been blessed with children of their own due to biological reasons. They wish to adopt a child. They have applied to this court to be allowed to adopt baby H.H (the child). The child was presumed to have been born on 15th April 2024. She was found abandoned in a thicket near Ndwaru located near Kawangware in Nairobi on the same day 3. A report was made to Kabete Police Station on the same day. The child was admitted at Eagles Hospital on the same day that she was found. She was transferred to Hope Babies Home on 24th April 2024. to the custody of the said Children’s Home on the same day pending formal adoption proceedings. 4. The Hope House confirmed that nobody turned up to claim the child since her admission and did not receive any information from the police regarding any claimants; the child was consequently declared free for adoption on 21 st August 2025 and was placed in the care of the applicants on 12th September 2025. They took custody of the child on the same day. Since then, the child has been in the custody and care of the applicants. 5. Prior to the hearing of the adoption, the State Department of Children's Services, Little Angels Network, the guardian ad litem and LAN Adoption Society prepared reports which were filed in court. They also issued a certificate declaring the child free for adoption. The certificate is dated 21st August 2025. The Director of Children’s Services prepared a report which is on record. 6. The guardian ad litem, CK.K, prepared a report which has been filed in court. All the reports are favourable and recommend that the court allow the applicants to adopt the child. I have evaluated the facts of this adoption. This is a local adoption. 7. It is evident that the applicants have fulfilled all the legal requirements pertaining to the adoption of the child. The consent of the biological parents of the child was dispensed with since the child was abandoned at birth. They cannot be traced to give their consent. 8. This court is satisfied that the applicants are qualified and able to take care of the child. The home visits by the guardian ad litem, the Adoption Society and the Director of the Children Services established that the applicants have the financial capability to provide for the upkeep and education of the child. 9. This court observed that the applicants had the child in court. It was evident that in the period that the applicants have had the custody of the child, the child has bonded well with them. The child considers the applicants her parents. 10. This court formed the opinion that it would be in the best interest of the child to be adopted by the applicants. I allow the applicants’ application for adoption. The applicants, S.T.K and M.N.W, are hereby allowed to adopt Baby H.H. 11. Henceforth, the child shall be known as A.M. Her date of birth shall be 15th April 2024. R.W.W, sister to the 2nd applicant, and S.M.K husband to the 2nd applicant's sister, shall be the legal guardian of the child should such eventuality arise. Page 2 of 3
