Pius Mweteru Njonjira v Republic

Njonjira v Republic (Criminal Revision 70 of 2026) [2026] KEHC 11917 (KLR) (30 July 2026) (Ruling) Neutral citation: [2026] KEHC 11917 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KIBERA CRIMINAL REVISION 70 OF 2026 DR KAVEDZA, J JULY 30, 2026 BETWEEN PIUS MWETERU NJONJIRA ................................................................ APPLICANT AND REPUBLIC ............................................................................................ RESPONDENT RULING 1. The applicant was charged and convicted of the offence of causing grievous harm contrary to section 234 of the Penal Code. He was sentenced to four (4) years imprisonment. 2. He has now filed a petition seeking revision of sentence. I have considered the application, the affidavit in support and the applicable law. I have also considered the trial court record. The issue for consideration is whether the sentence meted out is sufficient in view of the conviction against the applicant. 3. It is imperative that this court duly considers the mitigating and aggravating factors in the instant case. [See Marindany v Republic [2023] KECA 450 (KLR)]. The mitigating factors are that he is a first offender, he has spent a substantial amount of his sentence in custody and he is remorseful. Nonetheless, the lower court records indicate that the applicant exerted excessive force on the complainant, so much so that he would have lost his life if he had not sought medical intervention. 4. Considering both the aggravating and mitigating circumstances surrounding this case, I find that the sentence granted is sufficient. 5. In view of the foregoing, the application dismissed for lack of merit. The applicant is to serve his sentence to completion. Orders accordingly.
