Eboso v Republic (Miscellaneous Criminal Application E063 of 2026) [2026] KEHC 8800 (KLR) (22 June 2026) (Ruling) Neutral citation: [2026] KEHC 8800 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KIBERA MISCELLANEOUS CRIMINAL APPLICATION E063 OF 2026 DR KAVEDZA, J JUNE 22, 2026 BETWEEN VINCENT ADOLO EBOSO .................................................................... APPLICANT AND REPUBLIC ............................................................................................ RESPONDENT RULING 1. The Applicant, jointly with another not before this Court, was charged and convicted of robbery with violence contrary to Section 296(2) of the Penal Code, Cap 63 Laws of Kenya, in Kibera Chief Magistrate’s Court Criminal Case No. 3999 of 2008. He was sentenced to death. His appeal to this Court in Nairobi Criminal Appeal No. 698 of 2010 was dismissed on 17th June 2014. The sentence was subsequently commuted to life imprisonment. On 30th May 2024, this Court further revised the sentence to thirty (30) years’ imprisonment, effective from the date of arrest. 2. The Applicant now moves the Court for sentence review, contending that he has been in custody for eighteen (18) years, a period he considers sufficient for rehabilitation. 3. This court has considered the probation report which is on record. It indicates that the Applicant has demonstrated positive conduct while in custody and has participated in various trainings and counselling programmes which have contributed to his rehabilitation and preparedness for reintegration. The report is favourable. 4. Having considered the material placed before Court, including the Probation Report, the Applicant’s conduct while in custody, and the balance of two (2) years of the sentence pursuant to the Chief Justice’s Memo dated 7th December 2022, I am satisfied that the Applicant has attained sufficient rehabilitation to warrant a non-custodial approach for the remainder of the sentence. 5. In the premises, the application is allowed. The applicant is placed on probation for a period of two years under the supervision of the Kibera Probation Officer. https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/8800/eng@2026-06-22 1
