Patrick Ambani Kenyani v Republic

Kenyani v Republic (Criminal Revision 30 of 2026) [2026] KEHC 6773 (KLR) (19 May 2026) (Ruling) Neutral citation: [2026] KEHC 6773 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KIBERA CRIMINAL REVISION 30 OF 2026 DR KAVEDZA, J MAY 19, 2026 BETWEEN PATRICK AMBANI KENYANI ............................................................. APPLICANT AND REPUBLIC ............................................................................................ RESPONDENT RULING 1. This file was opened for purposes of considering whether the convict Patrick Ambani Kenyani is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022. 2. The applicant was charged and convicted for the ofience of defilement contrary to section 8 (1) as read with Section 8 (2) of the Sexual Offences Act. He was sentenced to serve 12 years imprisonment. 3. The Court called for a probation report to assess the applicant’s suitability for a non-custodial sentence. The report indicates that he has attended various training and counselling sessions which have contributed to his rehabilitation. His family has also expressed commitment to supporting his reintegration into society. 4. In view of the foregoing, I find that the applicant is suitable for early release, the probation report having been favourable. A non-custodial sentence is therefore appropriate in the circumstances. 5. Consequently, the applicant is released on Community Service for a period of one (1) year under the supervision of the Hamisi Probation Officer. Orders accordingly. RULING DATED AND DELIVERED VIRTUALLY THIS 19TH DAY OF MAY 2026 ________________ https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/6773/eng@2026-05-19 1
