APPELLANT AND JOHN KIPRON TONUI ............................................................... 1ST RESPONDENT ANTHONY CHERUIYOT ROTICH .......................................... 2ND RESPONDENT RULING 1. This is a Ruling to the Application dated 27th January, 2026. 2. It is clear that the Application was dealt with the by Court on 4th February, 2026. The temporary Orders of stay were issued and were conditional. 3. The Applicant was to deposit half of the Decretal Sum in Court within 14 days. 4. As at the time of handling this matter on 4th May, 2026 the Applicant was yet to comply. 5. I find that the Respondent clearly says they are not filing any response in view of the non-compliance and seeks that the application be dismissed. 6. I agree with the Respondent, the Applicant has failed to comply with the Orders of this Court. 7. Accordingly, the Application dated 27th January, 2026 is dismissed. 8.
