EEO v Republic (Miscellaneous Criminal Application E040 of 2026) [2026] KEHC 6452 (KLR) (14 May 2026) (Ruling) Neutral citation: [2026] KEHC 6452 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KIBERA MISCELLANEOUS CRIMINAL APPLICATION E040 OF 2026 DR KAVEDZA, J MAY 14, 2026 BETWEEN EEO ............................................................................................................. APPLICANT AND REPUBLIC ............................................................................................ RESPONDENT RULING 1. The applicant herein was charged before the lower court with the offence of Incest contrary to section 20 (1) of the Sexual Offences Act, No. 3 of 2006. He was sentenced to twenty (20) years' imprisonment. 2. He filed an appeal challenging his conviction and sentence to the High Court at Kibera vide Criminal Appeal No. E078 of 2025, which was dismissed in its entirety. 3. He has filed an application dated 10th day of March 2026 seeking sentence review. The averment made in support of the application is that since his incarceration, he has undergone sufficient rehabilitation. He urged the court to issue a non-custodial sentence. 4. I have considered the application, the grounds in support, and the applicable law. From the record of the trial court, the court considered the applicant’s mitigation, the time spent in remand custody and the fact that the applicant was a first offender before sentencing. The sentence imposed was also legal. 5. In my view, I find no good cause to revise the sentence imposed by the trial court. The application is dismissed for lacking in merit. Orders accordingly. RULING DATED AND DELIVERED VIRTUALLY THIS 14TH DAY OF MAY 2026 ............................. D. KAVEDZA https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/6452/eng@2026-05-14 1
