This Court delivered a Ruling on 27th January, 2026 in respect of the applications dated 28th April, 2025 and 26th May, 2025, wherein it struck out the Memorandum of Appeal and the Notice of Motion application dated 28th April, 2025. 2. Upon delivery of the said Ruling, the Counsel for the Respondent urged the court to order for the release of the funds held in joint account of the advocates for the parties to its office bank account since it had been deposited as security for due performance. 3. Having heard the Counsel of the Respondent, the court notes that by consent recorded in the trial Court vide Kiambu CMCC No. 292 of 2015, the application is hereby allowed in the following terms:a.
