Republic v Abdullahi Ibrahim Bodole & 1 other

Republic v Bodole (Criminal Case 24 of 2017) [2026] KEHC 4237 (KLR) (28 January 2026) (Sentence) Neutral citation: [2026] KEHC 4237 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KITUI CRIMINAL CASE 24 OF 2017 LW GITARI, J JANUARY 28, 2026 BETWEEN REPUBLIC ................................................................................................. APPLICANT AND ABDULLAHI IBRAHIM BODOLE ................................................... RESPONDENT SENTENCE 1. I have considered the mitigation. I have also considered the pre-sentencing report filed by the Probation Officer. The accused was convicted for the Offence of murder contrary to Section 203 as read with Section 204 of the Penal Code (Cap 63 Laws of Kenya) which carries a sentence of death penalty. 2. The accused is a first offender. He caused the death of the deceased for no reason and in cold blood. He was armed with a sharpened sword which demonstrated that he had intention to cause death. The deceased was a young man with a young family which was devastated and badly affected by the death of their bread winner. 3. The family of the deceased was not compensated and are not likely to be compensated as there was no reconciliation. The accused has shown remorse but I note that the offence is serious the trial Judges noted it was gluesum and in cold blood and needs to be discouraged. I note that the accused has been in custody for a long time and this should be taken into account. A custodial sentence is called for to discourage and to deter. 4. I sentence the accused to serve twenty (20) years imprisonment. The sentence to run from 14/12/2017, the date the accused was presented in court to answer the charges and was remanded in custody. This takes into account the period spent in custody to proportionately reduced the sentence a provided under Section 333(2) of the Criminal Procedure Code. There is Right to Appeal within 14 days that has been explained to the accused. DATED, SIGNED AND DELIVERED AT KITUI THIS 28TH DAY OF JANUARY, 2026. https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/4237/eng@2026-01-28 1
