Krop v Republic (Criminal Revision E001 of 2026) [2026] KEHC 2891 (KLR) (4 March 2026) (Ruling) Neutral citation: [2026] KEHC 2891 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KAPENGURIA CRIMINAL REVISION E001 OF 2026 RPV WENDOH, J MARCH 4, 2026 BETWEEN DARWIN KROP ....................................................................................... APPLICANT AND REPUBLIC ............................................................................................ RESPONDENT (From original conviction and sentence in Criminal Case No. E.055 Of 2024 of the SPM’S Court at Kapenguria) RULING 1. Darwin Krop, the applicant herein, was convicted on his own plea of guilty for the offence of stealing contrary to section 275 of the Penal Code. He was sentenced to serve three (3) years imprisonment. 2. He applied for revision of the sentence and on 1/12/2025, this court declined the application. This is because the court sought a Probation Officers report. The Probation Officer revealed that the Applicant was not a first offender because he had been convicted for a similar offence of stealing in E005/2023 and was placed on probation on 28/8/2024 but had failed to adhere to the conditions given by the Probation Officer. 3. He came back today with a similar application for revision of sentence. The prosecution Counsel has opposed the application for reason that this court has no jurisdiction to determine it because this court has previously dealt with the same matter. 4. This court having dismissed a similar application on 1/12/2025 has no jurisdiction to entertain a similar application. The same is dismissed. RULING DELIVERED, DATED AND SIGNED IN OPEN COURT AT KAPENGURIA THIS 4TH DAY OF MARCH, 2026. R. WENDOH https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/2891/eng@2026-03-04 1
