Vetlab Sports Club & 6 others v Sports Dispute Tribunal & 2 others

Vetlab Sports Club & 6 others v Sports Dispute Tribunal & 2 others (Judicial Review Application E427 of 2025) [2026] KEHC 2321 (KLR) (Judicial Review) (25 February 2026) (Ruling) Neutral citation: [2026] KEHC 2321 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT NAIROBI (MILIMANI LAW COURTS) JUDICIAL REVIEW JUDICIAL REVIEW APPLICATION E427 OF 2025 RE ABURILI, J FEBRUARY 25, 2026 BETWEEN VETLAB SPORTS CLUB ................................................................... 1ST APPLICANT ALLAN AZEGELE ............................................................................. 2ND APPLICANT JOHN KARIUKI ................................................................................ 3RD APPLICANT CAROLINE MUGUKU ..................................................................... 4TH APPLICANT RACHEL NDEI .................................................................................. 5TH APPLICANT SHITUL SHAH ................................................................................... 6TH APPLICANT BONIFACE MUNGAI ....................................................................... 7TH APPLICANT AND SPORTS DISPUTE TRIBUNAL ................................................... 1ST RESPONDENT JARED OUKO ............................................................................... 2ND RESPONDENT BEATRICE KAMAU ..................................................................... 3RD RESPONDENT RULING 1. Following the Ruling in JR E395/2025, it became apparent that the Respondents had concentrated their energies to the other matter and had not filed any responses to the substantive motion herein which was filed in separate proceedings. 2. It is for that reason that I find that it would be unjust and unfair to render judgment in this matter as if it is undefended yet the Respondents had actively participated in the original proceedings, without any evidence that they neglected or lost interest in the substantive motion. https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/2321/eng@2026-02-25 1

3. It could be that the Respondents may have presumed that had their application to set aside the orders for leave and stay been granted, then there would be no need to duplicate their efiorts. 4. For the above reasons, and in order to accord each party an opportunity to be heard and for a merit balanced decision, I recall the judgment scheduled for today in this matter and grant leave to the Respondents to, within then (10) days of today, file and serve their responses to the application dated 29/12/2025, together with written submissions. The Exparte Applicants will have 2 days thereafter service to file and serve brief rejoinder submissions. 5. Mention on 11/3/2026 to fix a judgment date. DATED, SIGNED AND DELIVERED AT NAIROBI THIS 25TH DAY OF FEBRUARY, 2026 R.E. ABURILI JUDGE https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/2321/eng@2026-02-25 2
