APPLICANT AND JGG ......................................................................................................... RESPONDENT RULING 1. In her application dated 1st August 2023 the Applicant seeks the following orders:(a) That the Respondent be ordered to append his signature for release of half of the funds available on the 15th day of each month in Bank Account No. 01109XXX at Cooperative Bank Kayole branch jointly held by both the Applicant and the Respondent. (b) That in the alternative the Applicant be mandated to withdraw half of the funds available in Bank Account No. 01109XXX at Cooperative Bank Kayole branch jointly held by both the Applicant and the Respondent. 2. The Applicant is premised on the grounds thereof and the Applicant’s sworn affidavit dated the same date. 3. The application is uncontested. 4. The basic averments in the affidavit is that since the dissolution of their marriage the Applicant has had to shoulder the responsibility of taking care of the children without much support from the Respondent. She states that since she has no funds to take care of them especially their schooling the only option is the joint account. 5. The Respondent has however declined to cooperate in signing for the withdrawal of the funds hence the application before me. https://new.kenyalaw.org/akn/ke/judgment/kehc/2026/252/eng@2026-01-22 1
