APPELLANT AND SAMUEL KAMAU ......................................................................... 1ST RESPONDENT RAHAB WANGUI MBUGUA ...................................................... 2ND RESPONDENT (Being an Appeal from the Judgment and Decree of the Honourable E. S. Olwande, SPM at Limuru CMCC No.57 of 2014 delivered on 11th January, 2016) RULING 1. The Chamber Summons application before the Court for determination is dated 1st April, 2025 in which the Appellant/Applicant seeks the following orders:a. That the Advocates now on record for the 1st Respondent Kinyanjui Kirimi & Company Advocates be granted leave to cease acting. b. That costs of the application be provided for. 2. The application is based on the grounds as set out on its face and the Supporting Affidavit of Kirimi David sworn on the instant date. The 1st Applicant’s Counsel havers that the 1st Applicant has failed to issue him with requisite instructions to assist in the expeditious disposal of the matter despite having severally reached out to her and thus his Firm is no longer in a position to act for or on behalf of the 1st Applicant and thus seeks leave to cease acting for her. 3. The court has considered the Advocates’ application and notes that the application was served upon the 1st Respondent and there is an Affidavit of Service sworn by Walter Motari on 24th September, 2025 which confirms that the application was personally served to the 1st Applicant through her Whatsapp https://new.kenyalaw.org/akn/ke/judgment/kehc/2025/19421/eng@2025-11-07 1

The Court then proceeds to find that since the said Respondent has neither filed a response or attended court to respond to the application, the court proceeds to allow the application dated 1st April, 2025 and orders:a. That the Advocates now on record for the 1st Respondent, Kinyanjui Kirimi & Company Advocates be and are hereby granted leave to cease acting. b. The 1st Respondent be at liberty to elect whether she will proceed in person our will engage other legal representation. It is so ordered.
