When this matter came up for mention on 13th November 2025, counsel for the Respondent informed this court that the Appellant had not complied with any of the courts directions on the hearing of the appeal. Counsel also indicated that he had served the Appellant with a mention notice for the mention of 13th November 2025. 2. He urged the court to dismiss the appeal and direct that the sum of the deposited as security be released to the respondent. 3. A perusal by the courts record however reveals that no affidavit of service for the mention of 13th November 2025 has been filed. 4.
