In re Adoption of Baby MD (Minor) (Adoption Cause E151 of 2025) [2025] KEHC 17614 (KLR) (Family) (27 November 2025) (Judgment) Neutral citation: [2025] KEHC 17614 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT NAIROBI (MILIMANI LAW COURTS) FAMILY ADOPTION CAUSE E151 OF 2025 HK CHEMITEI, J NOVEMBER 27, 2025 IN THE MATTER OF ADOPTION OF BABY MD (MINOR) IN THE MATTER OF BWW .......................................................................................................... APPLICANT JUDGMENT 1. In her Originating Summons dated 21st May 2025 the Applicant seeks orders that:(a) The Applicant be authorised to adopt Baby MD aka Baby M aka Abandoned Baby Boy, (unknown 1 week old minor) who is to be known as MDW and the Registrar General be directed to enter this adoption into the Register of Adoptions. (b) RWN be appointed as the legal guardian of the child. (c) The child be presumed to have been born on 8th June 2023 in Kenya. 2. The application is based on the applicant’s statement dated the same day as well as the supporting affidavits and the annexures thereto. 3. Namisi J on 17th July 2025 directed that a report be prepared by the Directorate of Children’s Services and appointed DAO as guardian ad litem. 4. On 30th October 2025 the Applicant, the minor, the guardian ad litem and the proposed legal guardian as well as the representative from the Children’s Services appeared before the court online. 5. The court interviewed them and they all appreciated their role. 6. It is obvious that though the Applicant resides in the United States where she works, she has a home in Nakuru Kenya and that is where the minor is together with the legal guardian and the Applicant’s mother as per the report dated 6th October 2025 from the Children’s Services. https://new.kenyalaw.org/akn/ke/judgment/kehc/2025/17614/eng@2025-11-27 1

7. Taking the totality of the above I do not find any reasons not to allow the application. The paper trail before the court sufficiently indicates that the same is merited. 8. In the premises the Originating Summons is hereby allowed as prayed and DAO is discharged as guardian ad litem. 9. On the other hand, RWN is appointed as the legal guardian. 10. Costs in the cause.
