RESPONDENT (Being an appeal against the judgment/ruling delivered on 8th February, 2022 by Honourable E.G. Nderitu, in Chief Magistrate Court in Molo Civil Case No. 75 of 2021) RULING 1. Upon reserving this matter for judgment, this Court noted from the record that the Appellant’s claim against the Respondent is about sale of land being Plot No. 607 Kasarani (Mathuki Area), between him and the Respondent and for which they had entered into a sale agreement. 2. He claimed that despite paying for it, the Respondent failed to transfer it to Appellant. He therefore sought specific performance among other reliefs. In the circumstances, the appeal lies within the jurisdiction of the Environment and Land Court under Article 162 (2) (b) of the Constitution and Section 13 of the Environment and Land Court Act. 3. Accordingly, and in the interest of justice, this appeal is hereby transferred to the Environment and Land Court for disposal. For that purpose, let it be urgently placed before the Presiding Judge of Environment and Land Court Nakuru today the 26th Day of November 2025 for further directions as to its disposal.
