Ndungú v Principal Secretary, Ofice of the President & another (Judicial Review Miscellaneous Civil Application 113 of 2013) [2025] KEHC 16268 (KLR) (Judicial Review) (12 November 2025) (Ruling) Neutral citation: [2025] KEHC 16268 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT NAIROBI (MILIMANI LAW COURTS) JUDICIAL REVIEW JUDICIAL REVIEW MISCELLANEOUS CIVIL APPLICATION 113 OF 2013 RE ABURILI, J NOVEMBER 12, 2025 BETWEEN ELIZABETH MUKAMI NDUNGÚ ........................................................ APPLICANT AND THE PRINCIPAL SECRETARY, OFFICE OF THE PRESIDENT .... 1ST RESPONDENT THE HON. ATTORNEY GENERAL .......................................... 2ND RESPONDENT RULING 1. This Court was prepared to hear the parties in this matter, having given them the hearing date by consent. However, the parties are not ready as Mr. Munene Counsel for the Respondents is said to be in a predicament, with an engagement before the Court of Appeal. 2. Secondly, he only served grounds of opposition upon the applicant yesterday and the applicant needs time to file a response thereto. It should therefore be made clear and for the record that the adjournment is prompted by the parties and not the Court. 3. The alternative dates suggested by Mr. Munene apparently are not suitable to Mrs. Wangombe counsel for the applicant. 4. For those reasons, the matter is taken out of the hearing list and rescheduled for hearing on 2/12/2025. The applicant has 7 days of today to file and serve a further affidavit if need be. 5. The applicant to serve a hearing notice upon the Respondent Counsel in personal conduct of the matter. https://new.kenyalaw.org/akn/ke/judgment/kehc/2025/16268/eng@2025-11-12 1
