APPELLANT AND SAN VALENCIA LIMITED ................................................................ RESPONDENT RULING 1. The only pending issue for determination in this matter is whether the deposit placed in court as security pending hearing and determination of the Appeal that has never been filed, despite leave to do so having been granted to the appellant should be released to the Respondent. 2. Parties confirmed to the court that there are no stay orders of execution in place. Indeed the appellant on 29/07/2025 sought time to obtain instructions on how and when the deposit would be released to the respondent. 3. The deposit at issue is Kshs. 625,000/=. The application dated 28/03/2025 has been resolved save for the deposit release. 4. To that end therefore, and there being no objection to release of the deposit of Kshs. 625,000/= deposited by the appellant as security pending hearing and determination of the appeal is hereby issued that the said security shall be released to the Respondent San Valencia Ltd through its advocates on record; Muthoga Gaturu & Co.
