Equity Bank (K) Limited v Njagi & 2 others (Civil Appeal E076 of 2025) [2025] KEHC 13388 (KLR) (Civ) (29 September 2025) (Ruling) Neutral citation: [2025] KEHC 13388 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT NAIROBI (MILIMANI LAW COURTS) CIVIL CIVIL APPEAL E076 OF 2025 LP KASSAN, J SEPTEMBER 29, 2025 BETWEEN EQUITY BANK (K) LIMITED ............................................................... APPLICANT AND CRISPN MURIMI NJAGI ............................................................. 1ST RESPONDENT FRANCIS NJOROGE KARANG ................................................ 2ND RESPONDENT THE ATTORNEY GENERAL ...................................................... 3RD RESPONDENT (Being an appeal from the judgment of Hon. Principal Magistrate C.K Cheptoo in Milimani CMCC No. 10277 of 2018 delivered on 29th November, 2024) RULING 1. This is basically an application to enlarge time of filing an appeal whose delay is for a few days. The main reason for the delay was that the Appellant advocate did not give the Appellant a copy of the lower Court Judgement and resigned from the main law firm leaving the Appellant in limbo. I will not belabor in citing cases to buttress the principles guiding leave to appeal out of time. This Court has already given a conditional stay that will secure the interest of both parties. I shall allow the application dated the 27th day of January 2025 in terms of prayer 3 and 4. 2. Each party shall bear own costs. 3. Orders Accordingly. DELIVERED, DATED AND SIGNED AT NAIROBI THIS 29TH DAY OF SEPTEMBER, 2025 L. P. KASSAN https://new.kenyalaw.org/akn/ke/judgment/kehc/2025/13388/eng@2025-09-29 1
