Republic v Vincent Omondi Ouru & 1 other

Republic v Ouru (Criminal Case E022 of 2023) [2025] KEHC 9550 (KLR) (30 June 2025) (Sentence) Neutral citation: [2025] KEHC 9550 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KISUMU CRIMINAL CASE E022 OF 2023 A MABEYA, J JUNE 30, 2025 BETWEEN REPUBLIC ............................................................................................ PROSECUTOR AND VINCENT OMONDI OURU ...................................................................... ACCUSED SENTENCE 1. I have considered the mitigation. That the accused is a first offender. That he is remorseful and would like to mend his relationship with the family and the Community. 2. I have considered that the offence occurred in a family set up, that it is the Accused’s own child who lost his dear life. 3. I have considered that the accused has owned up to his act and that the remaining children may not have someone to take care of them. 4. I have however noted the contents of the Pre-Sentence Report which is negative of the accused on the occurrence of the offence, his conduct and general attitude to his family. 5. His actions require deterrence. It is a sad situation. However, considering that he agreed to plea bargain and that saved the Court the time of the trial, I will sentence the accused top a lenient sentence of 15 years’ imprisonment. It is so ordered. DATED AND DELIVERED AT KISUMU THIS 30TH DAY OF JUNE, 2025. A. MABEYA, FCI Arb JUDGE https://new.kenyalaw.org/akn/ke/judgment/kehc/2025/9550/eng@2025-06-30 1
