Republic v James Mungai Njoroge Alias Jimmy Njoroge & 1 other

Republic v Njoroge alias Jimmy Njoroge (Criminal Case E004 of 2021) [2025] KEHC 3270 (KLR) (19 March 2025) (Sentence) Neutral citation: [2025] KEHC 3270 (KLR) REPUBLIC OF KENYA IN THE HIGH COURT AT KAPENGURIA CRIMINAL CASE E004 OF 2021 RPV WENDOH, J MARCH 19, 2025 BETWEEN REPUBLIC ............................................................................................ PROSECUTOR AND JAMES MUNGAI NJOROGE ALIAS JIMMY NJOROGE ....................... ACCUSED SENTENCE 1. The accused pleaded guilty to the charge of manslaughter contrary to section 202 as read with Section 205 of the Penal Code. He did not waste the court’s time. He has been treated as a first offender. 2. The court takes into account his mitigation that he is remorseful and has transformed from the various Biblical Courses he has undertaken while in remand. I have taken into account the presentence report. Unfortunately, the victims' relatives were not traced to give their input. It is clear from the report that the community did not know much about accused before the commission of this offence. Although the report recommends 3. probation, I find that the offence committed was a very serious one. Accused went into hiding for over two and half (2 ½) years. A young life of twenty-one (21) years was lost. The court also takes into account the circumstances of the offence, how it was committed. The accused is said to have been abusing alcohol. This court is of the view that a custodial sentence is more appropriate. I take into account the period spent in remand from 30/6/2021 to date. I hereby sentence the accused to eight (8) years imprisonment. Right of appeal in fourteen (14) days DELIVERED, DATED AND SIGNED AT KAPENGURIA THIS 19TH DAY OF MARCH 2025. R. WENDOH.
