Hillary Kiprotcih Rono was arraigned before this court to face a charge of murder contrary to section 203 as read with section 204 of the penal code. 2. After undergoing a full trial, the accused was instead convicted for the offence of manslaughter. Before sentencing this court called for a pre-sentence probation report and further invited the accused to submit facts in mitigation. He also asked this court to take note the accused underwent a full trial before being convicted. 4. I have further considered the pre-sentence probation report in which it is indicated that he is remorseful and regrets what happened. The report further indicates that the deceased’s family are opposed to the accused being given a non-custodial sentence until the reconciliation and cleansing rituals are done.
