THE BOARD OF TRUSTEES (Being an appeal from the decision of Honourable Samuel M. The appellants who appear in person filed the instant appeal by way of the memorandum of appeal dated 18 th December 2024 founded upon the grounds, inter alia; a) THAT the learned trial Magistrate erred in law and fact by dismissing the Plaintiff’s suit in its entirety for lack of locus standi. b) THAT the learned trial Magistrate erred the Law and fact by failing to put into consideration that the Appellants were the founding members of the school (St. Brigitas Girls Secondary School formerly Kipkaren Girls Secondary School) that sits on the suit land being NANDI/KIPKAREN SALIENT/74. 2. The respondent was represented by Magare Musundi and Company Advocates at the trial court. KAPSABET ELCLA NO. E016 OF 2026 RULING 3

3. By the Notice of withdrawal dated 21st day of January 2026, the Appellants have sought to wholly withdraw this Appeal against the Respondent with no orders as to costs, considering the respondent has not been served. 4. It is established law that a party’s liberty to withdraw a matter cannot be taken away and the court has to allow a party who has approached the court to withdraw such a matter, if he deems so fit to do. Furthermore, no prejudice will be caused to have the proceedings withdrawn; see Robert Mutiso Lelli vs Kenya Medical Training College & 2 others {2021} KESC 21 (KLR). 5. On that score, the appellants have the right to withdraw the appeal. 6. Furthermore, no prejudice will occasion on the respondent not duly served. 7. It is therefore, my considered view that the notice of withdrawal is merited. 8. Wherefore, the entire appeal by a memorandum of appeal dated 18th December 2024 is hereby marked as withdrawn with no orders as to costs. 9. This case is closed accordingly. KAPSABET ELCLA NO.
