Mukami v Mwongo (Enviromental and Land Originating Summons 48 of 2013) [2026] KEELC 119 (KLR) (19 January 2026) (Ruling) Neutral citation: [2026] KEELC 119 (KLR) REPUBLIC OF KENYA IN THE ENVIRONMENT AND LAND COURT AT MERU ENVIROMENTAL AND LAND ORIGINATING SUMMONS 48 OF 2013 BM EBOSO, J JANUARY 19, 2026 BETWEEN JOYCE MUKAMI ........................................................................................ PLAINTIFF AND CYPRIANO KIMATHI MWONGO ..................................................... DEFENDANT RULING (Ex-Tempore) 1. The Court has considered the application dated 10/12/2025 and the submissions of counsel. The record shows that this matter was disposed vide a final judgment dated 31/5/2016. It is correct that the extract of the said judgment should be a decree and not merely an order. 2. It is also true that the ofice of Executive Oficer does not exist in the ELC Registry. The functions that were hitherto performed by Executive Oficers are now vested in Court Administrators and Deputy Registrars. 3. Consequently, the Court is satisfied that the orders sought are merited. A decree shall be extracted out of the judgment of the court and the authority to execute shall be vested in the Deputy Registrar of the Court. The application is allowed in the above terms. 4. Orders accordingly. DATED, SIGNED AND DELIVERED AT MERU THIS 19TH DAY OF JANUARY, 2026 B M EBOSO [MR] ELC JUDGE In the presence of: Ms Abubakar for the Applicant/Plaintifi. https://new.kenyalaw.org/akn/ke/judgment/keelc/2026/119/eng@2026-01-19 1
