Ghulamu v Registrar, Land Registry, Kajiado & another (Miscellaneous Application E012 of 2025) [2025] KEELC 18630 (KLR) (26 November 2025) (Ruling) Neutral citation: [2025] KEELC 18630 (KLR) REPUBLIC OF KENYA IN THE ENVIRONMENT AND LAND COURT AT KAJIADO MISCELLANEOUS APPLICATION E012 OF 2025 LC KOMINGOI, J NOVEMBER 26, 2025 BETWEEN PETER NJUNGE GHULAMU ................................................................ APPLICANT AND REGISTRAR, LAND REGISTRY, KAJIADO ............................. 1ST RESPONDENT ATTORNEY GENERAL ............................................................... 2ND RESPONDENT RULING 1. This Ruling is in respect of the Chamber Summons dated 20th January 2025 brought under; Section 64 of the Kenya Constitution and any other land declared private under and acts of parliament. 2. It seeks orders; 1. That the respondent be ordered to Expunge the name as applied. 2. That costs of this application be provided for. 3. The grounds are on the face of the Chamber Summons and are set out in paragraph 1 to 3 4. The Application is supported by the Adavit of Peter Njunge Ghulamu, the Applicant herein on the 14th January 2025. 5. It is his case that he wishes to withdraw as holding the land in trust for his daughter. He prays that he be registered as the absolute proprietor. 6. I am of the view that no sucient particulars and or reasons have been given to merit the court to grant these orders. https://new.kenyalaw.org/akn/ke/judgment/keelc/2025/18630/eng@2025-11-26 1

7. The said “NLS” is a minor. Holding land in trust for a minor means that a trusted adult (the trustee) legally owns and manages the property for the benet of a child (the beneciary)until the child reaches the age of majority. 8. This is necessary because minors generally cannot legally own or manage the property themselves and to protect the land for their future use and nancial security. 9. It is clear that the Applicant holds the said land for the benet of the minor. 10. As stated the Applicant has not given reasons as to why the name of the minor should be struck out. 11. I am not satised that he has made out a good case for the grant of the orders sought. 12. The upshot of the matter is that I nd no merit in the Chamber Summons and the same is dismissed with no orders as to costs. DATED, SIGNED AND DELIVERED VIRTUALLY AT KAJIADO THIS 26TH DAY OF NOVEMBER 2025. L.KOMINGOI JUDGE In The Presence Of: Mr. B. Chakala for the Applicant. N/A for the Respondents.
