#What constitutes the estate of the deceased
The deceased's undivided half share in parcel KWALE/NG'OMBENI/1693, registered jointly with Mohamed Bakari Zimo, forms part of the estate.
Relying on the petition, the certificate of official search and the oral evidence, the court found the parcel registered in the names of the deceased and Mohamed Bakari Zimo as absolute proprietors. The deceased was therefore declared to hold an undivided half share, which constitutes his estate for distribution to the heirs.
Who are the rightful heirs
The four children named in the petition are the rightful heirs.
The court set out the requirements of Islamic inheritance: death of the owner, survival of heirs, an existing estate and a valid legitimate relationship. It found these satisfied and declared the three sons and one daughter named in paragraph 5 of the petition to be the rightful heirs, it not being in dispute.
Mode of distribution
Distribution in equal shares among all heirs by agreement, departing from the default twice-for-a-son rule.
Although Quran 4:11 prescribes that a son takes twice the share of a daughter, the petitioner and all heirs testified during the hearing that they had agreed the estate be distributed in equal shares among the male and female heirs. The court gave effect to that family agreement.
Legal principles established
#- The substantive law applicable to the estate of a deceased Muslim is Muslim law as provided by section 2(3) of the Law of Succession Act.
- Under Quran 4:11 a son's share is twice that of a daughter, but heirs may agree to equal distribution.
