#Whether the Kericho Kadhi's Court has territorial jurisdiction over the matrimonial cause
The Court has jurisdiction. Section 4(2) of the Kadhi's Court Act Cap 11 confers jurisdiction on one Kadhi's court over Nyanza, Western and specified Rift Valley districts including Kericho District. The Civil Procedure Act does not confer Kadhi's Court jurisdiction, and administrative convenience or lack of a local Kadhi's Court cannot oust statutory jurisdiction.
The objector relied on Section 15(a) of the Civil Procedure Act to argue suit should be filed where the defendant resides. The Court held the Civil Procedure Act, whose long title is to make provision for procedure in civil courts, does not confer jurisdiction on Kadhi's Courts; that is done by the Kadhi's Court Act, whose Section 4(2) expressly lists Kericho District. Administrative reasons for filing elsewhere cannot oust statutory jurisdiction, and virtual/automated court services render proximity largely irrelevant.
Whether the Honorable Kadhi should be disqualified on the ground that he socially knows the Petitioner
The disqualification claim failed; the objector did not prove the alleged friendship.
Rule 75(f) of the Kadhis' Courts (Procedure and Practice) Rules, 2020 disqualifies a Kadhi where enmity or friendship with a litigant is likely to affect impartiality. The objector alleged the Respondent repeatedly told her he socially knows the Kericho Kadhi. The Respondent denied it, and the Court found the burden of proof on the claimant was not discharged, viewing the allegation as a notion arising from her mistaken belief that Kisii County had a Kadhi's Court.
Legal principles established
#- Territorial jurisdiction of Kadhi's Courts is conferred by Section 4(2) of the Kadhi's Court Act Cap 11, not by the Civil Procedure Act; the absence of a Kadhi's Court in a county does not bar access to the nearest Kadhi's Court, and the statutory jurisdiction is not ousted by considerations of convenience, distance or court caseload
- The burden of proving disqualification of a Kadhi under Rule 75(f) of the Kadhis' Courts (Procedure and Practice) Rules, 2020 lies on the party alleging enmity or friendship
Court orders
#- 1.The Application/Objection challenging the jurisdiction of the Kericho Kadhi's Court is dismissed
- Jurisdiction invoked
- Kadhi's Court Act Cap 11, Section 4(2) (territorial jurisdiction); objection brought under Sections 1A, 1B, 3A and 63(e) of the Civil Procedure Act Cap 21 and Order 51 of the Civil Procedure Rules
