What this practically means
#Executive summary
#Questions the Court framed
#The issues the Court set itself to decide, in its own words.
- 1.Whether there was a valid marriage between the parties (validity of the alleged 'misyar' marriage) and whether it should be dissolved
- 2.Who is the owner of the consignment HBL No. 103198 with Zainco Door To Door Services worldwide freight forwarder
- 3.Ownership of the parcel known as title deed No. Kilifi/Chakama Phase II/264
Key legal issues
#Validity of the alleged 'misyar' marriage
The misyar marriage, conducted without a recognized guardian of the bride, was invalid, null and void.
The court set out the five pillars of marriage under Islamic law, including the waliy. Although the parties cohabited in Saudi Arabia as husband and wife and photos of a celebration were produced, there was no legal proof of marriage and the respondent's own position was conflicting. As the parties are Shafii Muslims, a marriage without a wali is not valid. The misyar arrangement without a recognized guardian therefore failed to meet the requirements of a valid marriage.
Ownership of the consignment with Zainco forwarders
The petitioner was declared the legal owner of the consignment HBL No. 103198 and Zainco was directed to release it to her.
The petitioner produced positive documentary uncontroverted evidence in the form of the HBL shipment form naming her as shipper. The respondent produced only photos of alleged items not listed in the HBL description and relied on negative evidence that the petitioner could not afford the items, which is inadmissible under Article 1699 of the Majalla. On the weight of evidence the petitioner's case was stronger and she discharged her burden on a balance of probabilities.
Ownership of the Chakama plot
The claim was dismissed for lack of jurisdiction in the Kadhi's Court and insufficient conclusive evidence.
The court held that disputes of property ownership are within the exclusive jurisdiction of the Environment and Land Court, and further that the petitioner did not provide sufficient conclusive evidence on the issue. The claim relating to title deed No. Kilifi/Chakama Phase II/264 was therefore dismissed.
Legal principles established
#- A valid marriage under Islamic law must fulfil five key requirements: consent of the bride and her waliy, husband and wife free from legal impediments, offer and acceptance, witnesses and dowry.
- A marriage conducted without a recognized guardian of the bride (wali) does not fulfil the requirements of a valid marriage under Islamic law.
- The burden to prove a claim rests with the claimant, who must discharge it positively and on the required standard; purely negative evidence is inadmissible.
- Disputes of property ownership relating to land are within the exclusive jurisdiction of the Environment and Land Court.

The judgment mixes singular and plural voice in the disposition ('in my view' vs 'We hereby order').
