Wafula v Postal Corporation of Kenya (Employment and Labour Relations Cause E053 of 2023) [2025] KEELRC 1478 (KLR)
The bottom line
#A Kenyan court threw out a worker's case because it was filed more than three years after dismissal, and the clock ran from dismissal, not the internal appeal.

#Key legal issues
#Whether the claim is time-barred under section 24(b) of the Postal Corporation of Kenya Act and section 90 of the Employment Act
The preliminary objection succeeded on limitation under the Employment Act; the claim filed on 27th October 2023 exceeded the three-year period running from dismissal on 22nd April 2020
The court held that section 24 of the Postal Corporation of Kenya Act does not apply to employment disputes, following Hantoosh. However, section 90 of the Employment Act (as quoted via section 89 discussion and Adagala) is mandatory: a contract of employment claim must be filed within three years. The cause of action accrued on dismissal on 22nd April 2020, not the appeal outcome of 23rd April 2021. Time ran out on 22nd April 2023, so the suit filed 27th October 2023 was out of time and could not be salvaged.
When the cause of action accrues where an internal appeal is pursued
The cause of action arose on the date of dismissal, not when the internal appeal was dismissed
The Claimant argued that time should run from the conclusion of internal disciplinary and appeal processes on 23rd April 2021. The court rejected this, holding that upon termination the cause of action arises immediately and a claimant should file while pursuing the internal appeal. The Postmaster General's letter upholding the dismissal confirmed that the dismissal notice of 22nd April 2020 was the operative act.
