Abdi Afadimo SHG Through the Chairman, Ali Abduba Abdi v Qabale & 6 others (Environment and Land Appeal E031 of 2025) [2026] KEELC 4782 (KLR)
The bottom line
#Kenya's Environment and Land Court confirmed that without a letter of allotment and registration, a group has no legal claim to land.
What this practically means

#Key legal issues
#Whether the Appellant proved ownership of plot number 1615 Chechelesi – Isiolo
It did not; the minutes relied on were unconfirmed and unratified, the PDP was unsigned and fake, and no letter of allotment was ever issued
The trial court reviewed all exhibits and found them incapable of conferring title. The minutes of the works, town planning and markets committee were neither confirmed nor signed as required by Section 80 of the Local Government Act and had not been adopted by the full council. The Appellant's own witness (PW5) testified that the PDP bore a fake signature and was unauthenticated. The Appellant conceded it had no letter of allotment, without which it was a busybody with a premature and stillborn claim.
Whether the trial magistrate misapplied Wreck Motors Enterprises Limited
She did not; the magistrate correctly applied the principle that title only accrues upon a letter of allotment, compliance with its terms, and issuance of title or lease
The court found counsel for the appellant had misunderstood the holding in Wreck Motors. That principle, reaffirmed by the Supreme Court in Torino Enterprises Ltd v Attorney General, is that even a holder of a valid allotment letter has no ownership rights until registration. The Appellant, having admitted no allotment letter was ever issued, was not even near the threshold of that case.
Whether the Appellant could introduce the new issue of 'protectable interests' on appeal
It could not; the issue was not pleaded, not in the grounds of appeal, and could not be snuck in on appeal
Parties are bound by their pleadings and cannot switch goal posts. Under Order 42 Rule 4 of the Civil Procedure Rules, 2010, an appellant may not urge a ground not set out in the memorandum of appeal except with leave. The only exception is a question touching jurisdiction, which this was not.
Legal principles established
#- A letter of allotment is merely an offer incapable of conferring interest in land; title accrues only upon perfection of conditions and registration
- A part development plan is a planning tool and not an ownership document
- Minutes of a local authority committee must be confirmed and adopted/ratified by the full council to be valid
- A party cannot raise a new issue on appeal that was not pleaded or included in the grounds of appeal
- A first appellate court must re-evaluate the evidence but will defer to trial court findings absent no evidence, perversity, misapprehension or demonstrable error of principle
