#Key legal issues
#Whether the Plaintiff acquired title by adverse possession
The claim fails; the Plaintiff's occupation was permissive under a caretaker agreement and never adverse for 12 years
The Plaintiff's own witnesses indicated she entered the property in 2010, previously residing in Mtopanga. The caretaker agreement dated 1st December 2010, which she did not prove to be a forgery, permitted her to occupy and manage the property for the registered owner. Possession under licence cannot be adverse, and the notice terminating the agreement expired on 1st April 2021, long before 12 years of adverse possession could accrue.
Whether the 1st Defendant's counterclaim for eviction and mesne profits succeeds
Judgment entered for the 1st Defendant on the counterclaim: eviction, demolition, mesne profits of Kshs. 1,000,000/= and costs
The court found that after the caretaker agreement was terminated by letter dated 1st March 2021 and the notice period expired on 1st April 2021, the Plaintiff's continued occupation was unlawful. The registered owner, holding a prima facie conclusive title under Section 26 of the Land Registration Act, was entitled to possession and to mesne profits for the period of unlawful occupation.
Legal principles established
#- To succeed in adverse possession a claimant must prove entry without the owner's permission, exclusive occupation, and open and continuous occupation for twelve years
- A certificate of title is prima facie conclusive evidence of proprietorship, impeachable only on proof of fraud, misrepresentation, illegality or procedural impropriety
Court orders
#- 1.The Plaintiff's suit is dismissed with costs
- 2.The Plaintiff is directed to demolish the structures built on the suit property and to forthwith vacate the same within 30 days, failing which the 1st Defendant may carry out the demolition and eviction at the Plaintiff's costs
- 3.The Plaintiff shall pay the 1st Defendant mesne profits assessed at Kshs. 1,000,000/= together with interests at Court rates
- 4.The Plaintiff shall pay the costs of the counterclaim to the 1st Defendant
- Jurisdiction invoked
- Limitation of Actions Act, Cap 22; Land Registration Act; original jurisdiction of the Environment and Land Court
