Francesca v Andreoli & another (Enviromental and Land Originating Summons E062 of 2025) [2026] KEELC 2295 (KLR)
The bottom line
#A Malindi court handed a woman full ownership of land she openly used and maintained for over 12 years without the owners' permission.
What this practically means
#Executive summary
#Questions the Court framed
#The issues the Court set itself to decide, in its own words.
- 1.Whether the plaintiff has been in open, continuous, exclusive and hostile (nec vi, nec clam, nec precario) possession of the defendants' half-share of the suit land for the statutory period of 12 years
- 2.Whether the plaintiff has demonstrated animus possidendi sufficient to extinguish the registered owners' title by adverse possession
Key legal issues
#Whether the plaintiff established adverse possession of the defendants' half-share of Portion No. 2989 Malindi
The plaintiff established both animus possidendi and possession nec vi, nec clam, nec precario from 2012 to date, exceeding the 12-year statutory period, entitling her to the declared half-share.
The plaintiff entered the neglected and abandoned half-share owned by the defendants in 2012 without permission, cleared the bush, incorporated it into her homestead and garden, constructed a perimeter wall enclosing the entire property, landscaped and maintained gardens and provided security and regulated access. The transfer from the first to the second defendant did not interrupt her possession, and neither defendant ever appeared on the land to assert rights or interfere with her possession. Her possession was therefore continuous, open, notorious and hostile to the registered title.
Legal principles established
#- The essentials of adverse possession are that the claimant must have occupied the suit land without force, without secrecy and without permission, and the statutory period in Kenya is 12 years.
- A claimant must demonstrate animus possidendi - possession in a manner hostile to the title of the registered owner.
Court orders
#- 1.The Originating Summons dated 30th April 2025 allowed as prayed in terms of prayers (a), (b), (c) and (d) thereof
The bench
#One judgment of the whole court — no separate or dissenting opinions.
Wrote the judgment
- Jurisdiction invoked
- Original jurisdiction of the Environment and Land Court over land titled Portion Number 2989 Malindi Municipality, Kilifi County
Quotable passages
#Verbatim from the judgment, each located to the page it appears on in the official PDF — so these can be cited and checked directly.
The possession must be continuous, uninterrupted, unbroken, for the necessary statutory period. This element means that the possession by the adverse possessor must continue without significant interruption for a solid block of time at least as long as the period of limitation, being at the moment twelve years before the filing of suit.
the respondent manifested animus possidendi, a clear mind and intention of dealing with the suit premises as if it was exclusively his and in a manner that was in clear confiict with the appellant's rights.
Having considered the contents of the Originating Summons and the supporting afidavit, I am of the view that the plaintifi has not only established animus possidendi, but also that she has been in possession of the suit land nec per vi, nec clam, nec precario.
I therefore allow the Originating Summons dated 30th April 2025 as prayed in terms of prayers number (a) (b) (c) and (d) thereof.
Issues in the judgment
#The second defendant/second respondent is not named anywhere in the judgment, and the first defendant is at one point referred to as 'first respondent' although the matter is not an appeal.
The judgment states it was signed and delivered on 21st April 2026 although the Originating Summons is dated 30th April 2025, an unusual but internally consistent chronology; no orders as to costs appear despite the suit being allowed.
Recurrent typographical errors including 'plaintifi' for 'plaintiff', 'adverse position' for 'adverse possession', and 'nec per vi' for 'nec vi'.
