#Whether lapsed interlocutory injunctive orders can be reinstated
They cannot; the injunction lapsed twelve months after grant by operation of Order 40 Rule 6 of the Civil Procedure Rules, and any extension could only have been sought before lapse
Order 40 Rule 6 provides that an interlocutory injunction lapses if the suit is not determined within twelve months unless the Court, for sufficient reason, orders otherwise. The injunction issued on 25th July 2024 lapsed around three weeks after the Motion filed on 2nd July 2025. No extension had been sought or granted before lapse. Having lapsed by operation of law, there was no order in existence capable of reinstatement.
Whether the plaintiff has locus standi to prosecute the suit pending resolution of competing grants in the succession causes
Until the muddle over the two grants to the Estate of William Juma Lukoyo is resolved in the succession court, it is uncertain who has locus standi; the plaintiff should prioritise the succession causes
Two grants exist over the same estate - one to the plaintiff and one to Krispinus Masiga Juma and Topista Adikinyi Juma, the latter revoked in Succession Cause No E379 of 2023, but with a fresh application for administration pending. The court adopted the analogy of a plane waiting on a runway: so long as the succession disputes remain unresolved, the suit and its motions cannot proceed, and this court has no role in resolving them.
Legal principles established
