#Capacity of officials of a dissolved Group Ranch to create new parcels of land
After dissolution in 1997, the officials' role was transitional only (winding up); they had no capacity to instruct a surveyor for a new subdivision, and any unmapped land after the Community Land Act would be community land
The court traced the dissolution of Oldonyo Rasha Group Ranch in 1997 following the Director of Land Adjudication's consent. It held the remaining officials' mandate was restricted to finalising existing obligations. Instructions given in June 2020 to the 3rd Defendant surveyor were therefore issued by a non-existent entity. Under Article 63(3) and the Community Land Act, any discovered unregistered land would vest in the community and require the statutory adjudication process, not action by former officials.
Validity of the Mutation Form and title Cis Mara/Oldonyo Rasha/1300 signed/thumb-printed by a deceased person
The Mutation was signed by Kelemet Ole Meingati after his death on 22nd July 2020, and his authority ended on death; the process creating parcel 1300 and its subdivisions including 1339 was void ab initio
All witnesses confirmed the Chairman died in July 2020, yet documents creating parcel 1300 and its subdivisions bore his signature/thumb print in 2021. The Land Registrar himself confirmed the procedure was wrong and that the title should have been registered in the name of the Group Ranch. Citing Macfoy, the court held that a void act is a nullity requiring no order to set aside, and the resultant subdivisions were candidates for cancellation under section 80 of the Land Registration Act.
Plaintiff's proprietorship and indefeasibility of title to parcel 169
The Plaintiff was the registered owner of parcel 169 since 2004 and his rights under section 25 of the Land Registration Act (formerly section 27/28 of the repealed Registered Land Act Cap 300) could not be defeated except as provided by law
The Plaintiff acquired parcel 169 in 2002 and obtained a title deed on 12th March 2004 for 62.45Ha, in possession without interference until June 2021. As a title holder following the 1997 subdivision of the Group Ranch land, he became an absolute and indefeasible proprietor. The Defendants' assertion that he fenced beyond his boundaries was not proved, and the court found his case proved on a balance of probabilities.
Legal principles established
#- Once a Group Ranch is dissolved and its land distributed, it ceases to be a legal entity and cannot transact, instruct surveyors or effect new subdivisions; unregistered land discovered thereafter is community land to be dealt with under the Community Land Act
- A void act is a nullity that requires no court order to set aside and every proceeding founded on it is equally null and void (applying Macfoy v United Africa Co Ltd)
- A title created by an unlawful, unprocedural and illegal Mutation is void ab initio and its resultant subdivisions are candidates for cancellation under section 80 of the Land Registration Act
Court orders
#- 1.Judgment entered for the Plaintiff against the Defendants jointly and severally in terms of prayers No. 1, 2 and 3 and 5 of the claim dated 2nd July 2021
- 2.Declaration that the Defendants' intention to subdivide parcel Cis Mara/Oldonyo Rasha/169 per the Mutation Form is illegal, null and void ab initio and the Mutation Form nullified
- 3.Declaration that title Cis Mara/Oldonyo Rasha/1339 was fraudulently registered and the same nullified and cancelled
- 4.Permanent injunction restraining the Defendants, their agents, servants and/or employees from subdividing, registering any subdivision, selling, transferring or otherwise interfering with parcel Cis Mara/Oldonyo Rasha/169
- 5.Any other relief the court deemed proper to grant
- 6.The Defendants' application for a further site/ground visit to determine the acreage of parcels 168 and 169 disallowed in its entirety
- Jurisdiction invoked
- Original jurisdiction of the Environment and Land Court under Article 162(2) of the Constitution (land and environment disputes) - not expressly cited in the extract
