Republic v County Government of Isiolo & 3 others; Mbogo & Muriuki Advocates (Ex parte Applicant) (Judicial Review E004 of 2025) [2026] KEELC 849 (KLR)
The bottom line
#Isiolo County officials were sent to prison for defying a court order to pay Kshs. 3.97 million, showing Kenyan courts will jail even senior officials.
What this practically means
#Executive summary
#Questions the Court framed
#The issues the Court set itself to decide, in its own words.
- 1.Whether the respondents have complied with the orders of the court issued on 24/11/2025 and if not, what are the legal implications of such failure
- 2.Whether the Honourable court is seized of the discretion to extend the timelines or otherwise
- 3.Whether the conduct of the County Police Commander – Isiolo County constitutes disobedience of lawful court orders
Key legal issues
#Non-compliance with the orders of 24/11/2025
The respondents disobeyed and wilfully failed to comply with the court orders; the self-executing default clause took effect, making the entire decretal sum of Kshs. 3,970,336/= due forthwith and triggering the committal of the contemnors to six months at Meru G K Prison
The orders of 24/11/2025 were consensual, unambiguous and self-executing, containing a default clause. Counsel for the respondents conceded non-compliance, attributing it to budgetary constraints, and admitted the respondents remained in contempt. No evidence of the alleged part-payment of Kshs. 1,805,000/= was tendered. The court therefore had no difficulty finding willful disobedience, activating both the accelerated payment and the committal provisions.
Discretion to extend timelines for a contemnor
The court has no discretion to grant a contemnor indulgence, including extension of timelines, before the contempt is purged; the respondents failed to establish any known exception
Relying on Fred Matiang'i v Miguna Miguna, the court held that a contemnor cannot approach the seat of justice and partake of the court's equitable discretion. The plea of budgetary constraints and the assertion that the CEC – Finance was out of the country were unsupported by documents. The application for extension was also mounted informally without due regard to the known provisions of the law.
Conduct of the County Police Commander – Isiolo County
The County Police Commander, Isaac Sang, disobeyed lawful court orders by failing to execute warrants of arrest served upon him despite confirming their validity, in breach of Articles 232, 244 and 245 of the Constitution read with the National Police Service Act
The warrants were extracted, signed and sealed, and served on the commander as shown by an affidavit of service. He wrote on 06/01/2026 seeking confirmation of validity, which the Deputy Registrar gave, yet he failed to effect the warrants or attend court on 03/02/2026 to show cause, sending no representative. The court held his conduct constituted disobedience of lawful court orders contrary to constitutional values of public service.
Legal principles established
#- Court orders are commands which must be obeyed unconditionally until set aside or rescinded; disobedience constitutes an attack on the rule of law
- A person found guilty of contempt cannot partake of the equitable discretion of the court, including extension of timelines, until the contempt is purged
- A mere assertion from the bar, unsupported by documents, is devoid of probative value and does not constitute sufficient cause

#The judgment repeatedly grants audience to the contemnors' counsel and considers their submissions despite holding that a contemnor is not entitled to audience before purging contempt, without expressly reconciling the two positions
The coram contains two inconsistent page markings ('Page 9 of 9' and '9') and no case file number is stated anywhere in the judgment
