Republic v Inspector General of Police & 3 others; Nkoimo & another (Interested Parties); Asanyo (Ex parte Applicant) (Environment and Land Judicial Review Case E002 of 2024) [2026] KEELC 802 (KLR)
The bottom line
#A Kenyan court struck out a late challenge to a taxed legal bill because the 14-day deadline under the Advocates Remuneration Order was missed without permission to file late.
What this practically means
#Executive summary
#Key legal issues
#Competency of the reference filed out of time
The impugned ruling contained the reasons for taxation, so the reference ought to have been filed within 14 days of 7th August 2025 (by 21st August 2025); no leave to enlarge time was sought under Rule 11(4), hence the reference is incompetent and struck out.
The court applied Rule 11 of the Advocates Remuneration Order. Following Ahmed Nassir v National Bank of Kenya, Kipkorir, Titoo & Kiara Advocates and other authorities, it held that where a ruling itself gives reasons, no separate request for reasons is required and the 14-day period runs from delivery of the ruling. The reference filed on 12th November 2025 was therefore out of time, and without an application for extension of time the court lacked jurisdiction to entertain it, without regard to merits.
Legal principles established
#- Where the reasons for the taxation on the disputed items are already contained in the considered ruling, the objector need not seek reasons and must file the reference within 14 days of the ruling; a reference filed out of time without leave under Rule 11(4) is incompetent.
Court orders
#- 1.The reference is struck out with costs to the Respondent
- 2.The stay orders are vacated
- Jurisdiction invoked
- Rule 11(4) of the Advocates Remuneration Order - reference against a taxing master's decision
