#Res judicata of the application dated 3.8.23
The application was res judicata because the prayer for extension of time had been raised and declined in the earlier application ruled on 21.7.23
The Respondent's first application (9.6.23) sought extension of time and substitution without praying for revival; the trial Magistrate held granting it would be in vain since the suit had abated. The subsequent 3.8.23 application raised the same extension prayer. Applying Rebecca Mijide Mungole, the sequence under Order 24 must be followed: extension of time first, then joinder, then revival. Having declined extension, the court could not revive the suit, and the second attempt was barred by section 7 of the Civil Procedure Act.
First appeal - scope of re-evaluation
The court as first appellate court was obliged to re-evaluate the evidence and draw its own conclusions per Selle v Associated Motor Boat Company
Section 78 of the Civil Procedure Act enjoins the first appellate court to re-evaluate, re-assess and re-consider the evidence adduced before the trial court and arrive at its own findings, subject to the caveat that it neither saw nor heard the witnesses (Selle v Associated Motor Boat Co Ltd). The court applied this standard to the impugned ruling and record of appeal.
Preliminary Objection upheld
The Appellant's Preliminary Objection dated 23.8.23 (res judicata/functus officio) ought to have been upheld
Having found the application res judicata, the court agreed with the Appellant that the trial Magistrate fell into error by allowing revival of the suit after previously dismissing the application for extension of time. The PO was merited and the impugned ruling had to be set aside and substituted with an order upholding it.
Legal principles established
#- Where a suit abates on death of a plaintiff, an application for revival or joinder cannot be made before time for substitution has first been extended; if the prayer for extension was raised and declined, a subsequent application to revive is res judicata
- On a first appeal the court must re-evaluate and re-assess the evidence and arrive at its own findings
