M’Mbogori v Njeru (Enviromental and Land Originating Summons E004 of 2023) [2025] KEELC 8458 (KLR)
The bottom line
#A Kenyan land court removed Absa Bank from a land dispute after confirming the loan was fully repaid, showing discharged chargeholders can exit land suits.
What this practically means
#Executive summary
#Key legal issues
#Necessity of an application for joinder already effected by the court
The application was superfuous and unnecessary because the court had already joined the Bank suo motu under Order 1 rule 10(2)
When the suit came up for substantive hearing on 7/7/2025, the court noticed the Bank on the land register as chargeholder and itself invoked Order 1 rule 10(2) to join it. An application seeking the same joinder thereafter duplicated an order already made and served no purpose.
Removal of a discharged chargeholder from the suit
The Bank, having confirmed full repayment of the loan and no interest in the suit land, was removed from the suit
The Bank attended through counsel, confirmed the charge had been fully repaid and stated it had no interest in the land and wished to be removed. On that basis the court exercised its discretion to strike it out of the proceedings.
Legal principles established
#- A court may, on its own motion, join a necessary party under Order 1 rule 10(2) of the Civil Procedure Rules where a party appears in the land register as holding an interest in the suit land
- A party joined whose interest in the suit land has ceased (charge fully repaid) may be removed from the suit
Court orders
#- 1.The Bank (Absa Bank Kenya PLC, formerly Barclays Bank of Kenya Ltd) is removed from the suit
- Jurisdiction invoked
- Order 1 rule 10(2) of the Civil Procedure Rules (necessary party joinder powers)
