Nariamao (Registered Trustee of Legio Maria of African Church Mission) v Ewoi (Environment and Land Appeal E001 of 2025) [2025] KEELC 8180 (KLR)
The bottom line
#Kenya's Environment and Land Court ruled a church's land case must be heard on its merits because 'res judicata' needs proper evidence, not just a prior lawsuit.

#Whether the suit was res judicata in view of the previous suit Lodwar SPMC Land Case No. 01 of 2020
The trial court erred in upholding the preliminary objection because the pleadings, evidence and judgment in the former suit were never formally placed before it; the trial court descended into the arena and relied on extraneous material without giving the appellant an opportunity to respond.
While the appellant did not dispute the existence of a prior suit between the same parties over the same subject matter decided on merits and to finality, the ingredients of res judicata had to be established on material properly before the court. The previous file was never formally introduced by way of pleadings, list of documents, or affidavit evidence. The trial court could not suo moto call for the previous file and determine the suit res judicata without allowing the appellant to respond to that material.
Whether the preliminary objection was a pure point of law
A preliminary objection must be a pure point of law argued on the basis of the pleadings, assuming all pleaded facts to be correct; it should not depend on contested facts or evidence.
Relying on Mukisa Biscuits and subsequent authorities, the court restated that a preliminary objection cannot be obscured by contested facts requiring evidence to ascertain. The respondent's objection required proof of the contents of the previous suit, which necessitated evidence; the court further noted that preliminary objections should not be used as a sword to win a suit destined to be resolved on the merits.
Whether the appellant's failure to disclose the previous suit in the plaint was fatal
The appellant's averment that there were no previous proceedings between the parties was a false statement under Order 7 Rule 1(1) of the Civil Procedure Rules, to be abhorred; however, this alone did not sustain the preliminary objection given the evidential deficiencies.
Order 4 Rule 1(1) requires an averment on previous and pending suits, and the appellant's verification falsely denied prior proceedings. The court condemned swearing of false affidavits but found that the procedural irregularity in how the previous file came before the trial court could not be cured by condoning the objection being upheld on extraneous material.
Legal principles established
