Mweni & 10 others v Muse & 2 others (Environment and Land Case E040 of 2023) [2025] KEELC 7816 (KLR)
The bottom line
#A Malindi court allowed a land dispute to continue against the Registrar of Titles and the Attorney General, but refused to join Kilifi county officials.
What this practically means
#Executive summary
#Key legal issues
#Joinder of parties under Order 1 rule 10(2) of the Civil Procedure Rules
Only parties whose presence is necessary for the effectual and complete determination of the issues should be joined; the Registrar of Titles and the Attorney General qualified, but the County Commissioner, Land Control Board Chairman and County Government did not.
The court applied the Civicon and Meme tests: a party should be joined where their presence enables complete settlement of all questions, protects rights otherwise adversely affected, and prevents proliferated litigation. Substantive relief was sought against the Registrar of Titles, and the Attorney General is the Government's legal representative. The other proposed parties played only limited administrative roles, or no cause of action was demonstrated against them.
Substitution of a deceased defendant
Substitution of Ahmed Naaman Ali Muse, said to be a Wakf Trustee, in place of the deceased 1st Defendant was proper.
The 1st Defendant, Abdullah Mohammed Muse, was deceased, evidenced by a death certificate annexed to the supporting affidavit. The 3rd Defendant acknowledged the death and described himself as a trustee of the wakf owning the subject property. The court found substitution proper to allow the suit to continue against the correct party representing the wakf.
Leave to amend the plaint
Leave to amend granted to give effect to the joinder and substitution.
Under Order 8 rules 3 and 5 of the Civil Procedure Rules and the overriding objective, amendments are freely allowed at any stage where necessary for determining the real question in controversy. Having found joinder of the Registrar of Titles, the Attorney General and the substituted defendant necessary, the court granted leave to amend, with the amended plaint to be filed and served within fourteen days.
