Ethics and Anti-Corruption Commission v Mgandi & 2 others; National Land Commission (Interested Party) (Environment and Land Case 85 of 2013) [2025] KEELC 7152 (KLR)
The bottom line
#The Environment and Land Court in Mombasa cancelled a Mombasa land title, ruling that land carved from a road reserve could never be validly allocated to private buyers.
What this practically means
#Executive summary
#Key legal issues
#Whether the suit property was available for allocation to the 1st defendant
No - it was part of a road reserve, already alienated as public land.
PW2 and PW4's evidence established from survey records that the property was hived from a road reserve, and letters from the Provincial Surveyor and District Commissioner confirmed it was on a road reserve. No evidence of de-gazettement was produced before allocation.
Whether the allocation was lawfully and regularly done
No - the statutory procedure was circumvented; no approved PDP existed.
PDP 12.4.CT.30.95 lacked the approved development number; the Director of Physical Planning had no record of it; survey preceded PDP approval; the 1st defendant produced no application, receipts or acceptance documents. The Commissioner of Lands approved the PDP despite clear indications of the road reserve.
Whether the 1st defendant acquired a good interest passable to the 2nd defendant
No - his title was void and the 2nd defendant's derivative title is invalid.
Following Funzi Development Ltd, indefeasibility attaches only to legally, properly and regularly obtained allocations. Since the root title was void, nothing passed to the 2nd defendant.
Whether general damages should be awarded
Refused.
The fraud was perpetrated by the office of the Commissioner of Lands in collusion with the 1st defendant; damages would allow the government to profit from its own wrong. Restoration of the property as public land suffices.
Legal principles established
#- A registered proprietor acquires absolute and indefeasible title only if the allocation was legal, proper and regular; courts cannot sanction illegally obtained titles on the basis of indefeasibility.
- Under the repealed Government Lands Act, an approved Part Development Plan must precede allocation of un-alienated government land, and a letter of allotment must be based on the approved PDP.
- Fraud must be distinctly pleaded and distinctly proved; general allegations are insufficient.
- Where allocation procedures were not followed, the allottee acquires no good title capable of passing to a third party.
Court orders
#- 1.A declaration that the grant culminating in issuance of titles on or about 19th January 1996 in favour of the 1st defendant over MN/I/9816 (Grant Number CR 28XXXX) was issued ultra vires the 3rd defendant's statutory powers and is illegal, null and void ab initio.
- 2.A declaration that the said grant is incapable of vesting an interest in the suit property or proper title in the 1st and 2nd defendants.
- 3.An order directing the Land Registrar Mombasa to rectify the register by cancellation of the entries relating to the issuance of the Certificate of Lease in favour of the 1st defendant over MN/I/9816.
- 4.An order directing the Land Registrar Mombasa to cancel entries relating to any other interest purportedly created pursuant to the cancelled Lease/Certificate of Lease over MN/I/9816.
- 5.A permanent injunction restraining the 1st and 2nd defendants and their agents from trespassing upon, transferring, leasing, wasting or otherwise interfering with MN/I/9816 other than by way of surrender to the Government of Kenya.
- 6.The 1st to 3rd defendants to bear the plaintiff's costs and interests at court rates.
- Jurisdiction invoked
- Original jurisdiction of the Environment and Land Court under Article 162(2)(b) of the Constitution (land and environment)
