Githogori & Harrison Associates Advocates, LLP v Ngugi (Environment and Land Miscellaneous Application E018 of 2024) [2025] KEELC 6294 (KLR)
The bottom line
#A Kenyan court refused to pause collection of taxed legal fees, ruling it had no jurisdiction because the client never appealed the taxation decision.
What this practically means
#Executive summary
#Key legal issues
#Whether the court has jurisdiction to grant stay of execution of its judgment entered on the certificate of taxation pending a suit in a subordinate court
The court lacks jurisdiction. Its mandate is limited to entering judgment under Section 51(2) of the Advocates Act and handling references under rule 11; the applicant, having exhausted those options, cannot pursue a stay in another court.
The court invoked the Owners of the Motor Vessel 'Lillian S' principle that jurisdiction is everything. It noted the applicant never appealed or sought review of the 9th May 2025 ruling, but instead filed a separate suit in Milimani COMMSU. Section 34(1) of the Civil Procedure Rules requires all questions relating to execution, discharge or satisfaction of a decree to be determined by the executing court, not by a separate suit. Considering the application would therefore be assuming jurisdiction the court does not have.
Legal principles established
#- Once a taxing master has taxed costs and issued a certificate of costs which is not set aside or altered, the court's only mandate is to enter judgment; no separate suit or stay application lies
Court orders
#- 1.The application dated 17th June, 2025 is dismissed with costs
- Jurisdiction invoked
- Section 51(2) of the Advocates Act; the court limited to entering judgment on a certificate of taxation and hearing references under rule 11
