#Beneficial ownership arising from purchase and transfer of share certificate
The defendant, having purchased the suit property in 1982 from the plaintiff's father and had the share certificate transferred to her, became the beneficial owner notwithstanding registration of the plaintiff
The court found the agreement and transfer of the share certificate spoke for themselves. The defendant was permitted to construct and did construct on the land. The plaintiff nonetheless caused the land to be registered in his own name despite his father having sold it, creating a duty to transfer the property to the purchaser.
Proof of the counterclaim
The defendant proved her counterclaim on a balance of probability, entitling her to rectification of the register
The court weighed the evidence of purchase, transfer of shares, permission to construct and occupation against the plaintiff's failure to attend hearing and his registration of the land in his own name. On that evidence the counterclaim met the civil standard.
