Durham (Suing as the Legal Representative of the Estate of the Late Reuben Mutuku Kiva - Deceased) v Mutuku & 5 others (Environment & Land Case E001 of 2023) [2024] KEELC 677 (KLR)
The bottom line
#A Machakos court allowed a family's land fraud claim to proceed, ruling that fraud allegations require full evidence and can't be thrown out early.
What this practically means
#Executive summary
#Key legal issues
#Res judicata
The suit is not res judicata because the succession cause summons were dismissed for want of jurisdiction and Machakos ELC Case No. 38 of 2023 was withdrawn, so neither was heard and determined on merit
Applying Section 7 of the Civil Procedure Act and the five-element test in John Florence Maritime Services, the court found no final determination by a competent court of the same issues between the same parties. Justice Odunga had directed that the issues of acquisition of the suit land be dealt with by the ELC for lack of jurisdiction, and the earlier ELC suit was withdrawn, so the requirements of finality and concurrence of jurisdiction were not met.
Limitation of actions
The suit is not statute barred since fraud is alleged and limitation does not run until discovery of the fraud; fraud requires oral evidence and cannot be resolved on a preliminary objection
Section 26 of the Limitation of Actions Act postpones the commencement of limitation where the action is based on fraud or mistake until discovery or constructive discovery. The Plaint raises allegations of fraud and illegality in acquisition of title, and the land belonged to a deceased's estate whose succession cause remains pending. Determining fraud requires oral evidence, so it cannot be resolved on a pure point of law.
Locus standi and propriety of the preliminary objections
The Plaintiff, holding Letters of Administration Ad Litem, has locus standi; the preliminary objections were premature as no defence had been filed to establish the factual foundation
The Plaintiff was issued Letters of Administration Ad Litem on 14th June 2023 permitting her to file and prosecute the suit. The Defendants filed no defence to controvert the Plaintiff's averments; a preliminary objection must stem from the pleadings and be a pure point of law with no facts to be ascertained, which these were not given the pleaded fraud and trespass issues.
Legal principles established
#- A preliminary objection must raise a pure point of law on assumed pleaded facts and cannot be raised where facts must be ascertained or discretion exercised
- Where allegations of fraud are raised, limitation does not begin to run until the plaintiff discovered or could with reasonable diligence have discovered the fraud
- Where a defendant fails to file a defence rebutting the plaintiff's averments, the claim remains unopposed; defendants should file a defence before lodging preliminary objections on factual issues
Court orders
#- 1.The two Notices of Preliminary Objection dated 26th July, 2023 are premature and are disallowed
- 2.The Defendants to file and serve their Statements of Defence within twenty-one (21) days from the date of the ruling
- 3.Costs will be in the cause
- Jurisdiction invoked
- Environment and Land Court jurisdiction (Art. 162(2)(b) context; suit directed to ELC by the High Court in Succession Cause No. 39 of 2016)
