#Abatement of suit against deceased defendant
The suit against Herine Atieno Ochola abated on April 20, 2022 as no substitution was made within one year of her death
Order 24 rule 4 of the Civil Procedure Rules is couched in mandatory terms requiring substitution of a deceased defendant's legal representative within one year. Herine died on April 20, 2021 and was never substituted, so the claim against her abated by operation of law on April 20, 2022.
Lis pendens and alienation of suit property
The defendants contravened the doctrine of lis pendens by subdividing and transferring portions of the suit property during the pendency of the proceedings
The subdivisions and transfers to third parties occurred on or after April 24, 2018, while these proceedings were pending. The doctrine applies from initiation of proceedings until determination and binds third parties regardless of notice. However, the court could not cancel the subdivisions without hearing the affected parties, per the right to fair hearing under Article 50 and audi alteram partem.
Adverse possession and identification of the suit property
The suit was incompetent: the plaintiff produced a green card for a different parcel (Uyoma/Kobong/269) and failed to comply with Order 37 Rule 7(2)
Two distinct parcel numbers cannot exist over the same land. The plaintiff's uncertified green card related to a different parcel opened on a different date, and her pleadings referenced the suit property. Failure to annex an extract of title was fatal to an Order 37 originating summons claiming adverse possession. The plaintiff also failed to join the registered owners of the subdivided portions.
Legal principles established
#- Where a defendant dies and is not substituted within one year, the suit abates against her by operation of law
- Lis pendens binds third parties who acquire interests in the subject matter during the pendency of proceedings whether or not they had notice
- The court cannot render judgment on a nonexistent parcel of land
Court orders
#- 1.The plaintiff's suit is dismissed
- 2.Costs awarded to the 1st defendant
- Jurisdiction invoked
- Articles 50 of the Constitution and sections 7, 13, 17 and 38 of the Limitation of Actions Act; Order 37 of the Civil Procedure Rules (adverse possession originating summons)
