The bottom line
#What this practically means
#Executive summary
#Key legal issues
#Extension of validity of expired summons to enter appearance
The Plaintiff gave sufficient reasons for failure to serve the original summons within their validity period; the court exercised its discretion to allow re-issue and extension in the interest of justice
Order 5 Rule 2(2) empowers the court to extend the validity of unserved summons where it is just to do so, and Order 50 Rule 6 permits enlargement of time even after expiry. The court was persuaded by Trident Insurance and Letshego Kenya that extension may be granted even where summons have expired. Given the failed attempts at service in the USA through the Kenyan Mission, extension served the ultimate goal of determining the dispute and guaranteeing the defendants notice and an opportunity to be heard.
