#Whether joinder of parties is permissible after judgment has been delivered
Joinder under Order 1 Rule 10(2) is only available while proceedings are pending; once a suit is concluded there is nothing to join to
The court examined Order 1 Rule 10(2) and noted that its purpose is to enable the court to effectually and completely adjudicate upon and settle all questions in the suit. Since proceedings end upon entry of judgment, joinder after conclusion serves no purpose. Following Mayfair Holdings, Lilian Wairimu Ngotho, JMK v MWM and Tang Gas Distributors, the court held the applicants could not be joined to a suit concluded on 25th September 2017.
Whether the Applicants have an alternative remedy
The Applicants may file a fresh suit against the Respondent since they claim distinct parcels of land from that litigated
The court observed that the Applicants appear to claim parcels distinct from the Respondent's Plot No 293 (LR 12062/885). Rather than joining them, the proper course is a fresh suit in which they can fully ventilate their claims, an opportunity unavailable to interested parties, whose rights are confined to the issues raised by the principal parties.
Legal principles established
#- A party may only be joined to a suit under Order 1 Rule 10(2) during the pendency of the suit, not after it has been concluded

- Jurisdiction invoked
- Order 1 Rules 9 and 10(2) of the Civil Procedure Rules, 2010
