Ruth Wambui Nganga v Ngong Butchers Co-operative Limited [2021] KEELC 1437 (KLR)
The bottom line
#The Environment and Land Court refused to let a land buyer sue over a decade late, confirming Kenya's six-year limitation deadline for contract claims applies strictly.

#Territorial jurisdiction
The objection to territorial jurisdiction was not available to the respondent: the Kajiado ELC did not exist when the suit was filed, the objection was not raised in the grounds of opposition, and an earlier ruling settled the issue unchallenged
The suit property is in Ongata Rongai, Kajiado County. Section 13(1) of the Environment and Land Court Act confers jurisdiction over land disputes, and Section 12(a) of the Civil Procedure Act requires suit where the subject matter is situated. However, the Kajiado ELC did not exist when the suit was filed, the respondent did not plead the objection in its grounds of opposition, and the court had already ruled that it would dispose of the miscellaneous application - a ruling the respondent never challenged.
Limitation and leave to file suit out of time
The suit was statute barred; the right of action accrued in 2004 upon execution of the sale agreement, and the 2015 application exceeded the six-year contractual limitation period
Though the applicant claimed purchase in 1986, the exhibited sale agreement and receipts were dated 2004, so the right of action accrued in 2004. Section 4(1)(a) of the Limitation of Actions Act bars contract actions after six years. The applicant offered no evidence of when the respondent's 2005 suit was dismissed and no explanation for the ten-year delay; equity does not aid stale demands, so the claim was barred and the prayer for leave declined.
Legal principles established
