#Whether the Kigumo Land Dispute Tribunal decision was a bar (res judicata) to the suit
The Tribunal had no jurisdiction over title or trust, so its decision was a nullity and res judicata cannot apply
The Land Disputes Tribunals Act confined tribunals to boundary, occupation and trespass disputes. Trust and title questions fell under section 159 of the repealed Registered Land Act for the courts. The issue of trust was never heard and decided by a competent court, a precondition for res judicata under section 7 of the Civil Procedure Act. The Tribunal's eviction decision was therefore void.
Whether a customary trust over the suit land was established
Yes - the land was family land registered in the Defendant's name as muramati for his brothers, satisfying the Kieba elements
Unchallenged evidence showed the land belonged to Njuguna Karu, was allotted to the house of Hannah Wangari for her four sons, and was registered in the Defendant's name only because he was the eldest and married. The land was demarcated by the clan with boundaries respected on the ground. The claimant is family, the land was family land before registration, and the claim is against a family member registered as custodian.
Legal principles established
