#Whether the applicant's allegations of corruption, special interest and favoritism justified the judge's disqualification
Application dismissed; allegations were frivolous, vexatious and an abuse of court process, and unproven
The court traced a 30-year history of serial recusal applications against successive judges (Oguk, Kasango, Lesiit, Makau, Gikonyo) made whenever the judge insisted on concluding the matter. Applying the objective reasonable-apprehension-of-bias test, the court held the applicant failed to prove the strong allegations of corruption and collusion with defence counsel. The record showed the matter had been allocated to visiting judges, negating any special interest. The court adopted Judge Makau's earlier findings in the same suit.
Legal principles established
#- The test for recusal is objective: whether circumstances give rise to a reasonable apprehension of bias in the mind of a reasonable, fair-minded and informed member of the public; facts constituting bias must be specifically alleged and established
- A judge has a duty to sit and should not recuse on flimsy or baseless allegations
- Whoever alleges must prove; losing an application or an unfavourable interlocutory decision does not establish bias
Court orders
#- 1.The application dated 2/07/2019 seeking recusal of Hon. Justice Lucy Mbugua is dismissed with costs
- 2.The court will not entertain any further applications until finalization of the applications ready for ruling as at 22.6.2018 (applications dated 1.12.2011 and 16.12.2015)
- 3.The court to give a date for ruling on the two pending applications
- Jurisdiction invoked
- Original jurisdiction of the Environment and Land Court over pending suits filed in 1988; interlocutory application for recusal
