#Authority in representative suits
The representative action was rightly struck out because the authorization to act was a list of members prepared for Society elections, not a written authority signed and filed as Order 1 rule 13(2) requires.
Order 1 rule 13(2) of the Civil Procedure Rules 2010 requires that authority for one party to appear, plead or act for others be in writing, signed by the party giving it and filed in the case. The list of farmers attached to the plaint related to the Society's elections of 30th March 2011 and bore no endorsements by the authorized officials of the Society authorizing the appellants to institute proceedings on behalf of the Society or its members. The representative action was therefore unsustainable and liable to be struck out.
Striking out a plaint for non-disclosure of previous proceedings
A suit cannot be struck out for failure to disclose previous proceedings, as Order 4 rule 1(6) does not list such failure among the grounds for striking out a plaint.
Order 4 rule 1 sets out the particulars of a plaint, and rule 1(6) permits striking out for non-compliance with specified sub-rules concerning verifying affidavits and written authority. A failure to disclose that a previous suit was filed is not specified as one of the reasons upon which a court may strike out a suit. Accordingly, the High Court had no mandate to strike out the entire suit under Order 4 rule 1(f), and doing so was an error of law.
Injunctive relief - misapprehension of the subject matter of the dispute
The learned judge misdirected himself by assessing the injunction application on the basis of the Gazetted portion when the dispute concerned the ungazetted portion occupied by the appellants.
The Motion read with the supporting affidavit showed that the appellants sought to restrain Dominion from interfering with the ungazetted portion of approximately 3,200 hectares which had never been gazetted and remained trust land, and not the Gazetted portion of 3,700 hectares lawfully leased to Dominion under Gazette Notice No. 2570. By determining the application on the basis of the Gazetted portion, the judge misapprehended the facts and the law, warranting appellate interference with the discretion.
Legal principles established
#- A representative suit cannot be sustained where the written authority required by Order 1 rule 13(2) of the Civil Procedure Rules has not been filed; an election list without endorsements by authorized officials does not constitute authority to act.
- Order 4 rule 1(6) of the Civil Procedure Rules does not empower a court to strike out a suit for failure to disclose previous or pending proceedings.
- A plaintiff suing in his own individual capacity may pursue his suit notwithstanding the failure of a representative action.
